Any collaboration, commission, licence, assignment, production agreement, option, adaptation or other commercial arrangement relating to material presented on this website must be expressly agreed in writing.
Viewing, accessing or discussing material displayed on the website does not grant any right to reproduce, adapt, develop, exploit or commercially use that material.

Unless prior written authorization has been obtained, no protected material may be:
copied;

This restriction applies regardless of whether the intended use is commercial or non-commercial, except where such use is expressly permitted by applicable law.
4.3 Film, Screenplay and Audiovisual Projects
Any screenplay, treatment, synopsis, scene, dialogue, character material, audiovisual proposal, film project, pitch document or other creative development material appearing on or communicated through this website remains subject to the intellectual property rights of its respective author or rights holder.
No publication, presentation, discussion, submission or disclosure of such material shall be interpreted as:
an assignment of copyright;
an option agreement;
a production licence;
an adaptation right;
permission to develop substantially reproduced protected elements;
permission to reproduce or circulate project documents;
or any other transfer of exploitation rights.
Any option, adaptation, development, production, co-production, publication, distribution, broadcasting or exploitation rights must be granted through a separate written agreement identifying the rights concerned and the terms of their use.
4.4 Creative Concepts and Works in Development
Certain material presented on this website may relate to concepts, ideas or projects that are still in development.
Nothing in these Terms is intended to claim exclusive copyright over an abstract idea where such protection is not recognised by law. However, the original expression, writing, structure, artwork, screenplay material, audiovisual material, documentation and other protectable elements through which a project is expressed remain protected to the extent provided by applicable intellectual property law.
4.5 Infringement
Unauthorised reproduction, representation, dissemination or exploitation of protected material may constitute copyright infringement and may result in civil and/or criminal proceedings under applicable law.
Under French intellectual property law, certain acts of copyright infringement may notably be punishable by up to three years' imprisonment and a fine of €300,000, without prejudice to potential civil remedies and damages.
5. Moral Rights and Attribution
Where applicable under French law, the author's moral rights remain reserved.
The integrity, authorship and attribution of original works must be respected.
No authorization to use a work shall be interpreted as permission to falsely attribute authorship, remove attribution, materially distort the work or otherwise interfere with the author's moral rights except where expressly permitted by law.
6. Contributions, Collaborations and Third-Party Material
Where another author, artist, professional or collaborator provides material for publication or inclusion in a project, that person represents that they have the necessary rights and permissions to provide such material.
Unless otherwise agreed in writing, contributors retain the rights they hold in their own original material.
Publication, correspondence, collaboration or participation in a project does not by itself create an assignment of intellectual property rights.
Any co-authorship, licence, commission, assignment, production participation or commercial exploitation arrangement should be governed by a separate written agreement.
7. Creative and Professional Services
The website may from time to time offer creative or professional services, including development, writing, consulting, artistic collaboration, creative direction, research or other project-based work.
The precise scope, price, timeline, deliverables and intellectual property rights relating to such services will be defined in the relevant quotation, proposal, invoice, contract or written agreement.
Unless expressly transferred in writing, commissioning or paying for work does not automatically transfer all intellectual property rights connected with that work.
8. Prices, Payment and Commissioned Work
Where prices are displayed, the applicable currency, taxes and payment conditions will be identified at the time of purchase or agreement.
Payment terms for commissioned creative work will be specified in the corresponding quotation, invoice or agreement.
Where advance payments, deposits or production costs are required, work may begin only once the agreed payment has been received.
Delivery dates for creative work are estimates unless expressly agreed as binding in writing.
9. Cancellation, Withdrawal and Refunds
Creative works, intellectual property licences, digital material and commissioned services may be subject to specific cancellation or refund conditions depending on the nature of the transaction and the status of the contracting party.
Where services are supplied exclusively to professionals, the applicable contractual terms will be those agreed between the parties, subject to mandatory provisions of French law.
For bespoke, commissioned or partially completed creative work, payments relating to work already performed, expenses incurred or rights already granted may be non-refundable where permitted by law and as specified in the relevant agreement.
Nothing in these Terms excludes any mandatory statutory right that cannot legally be waived.
10. Confidentiality and Unpublished Material
Certain creative projects or works may be shared privately before publication or production.
Material expressly identified as confidential, private, unpublished or supplied for evaluation only must not be copied, disclosed, circulated, published or used for another purpose without prior authorization.
Where greater confidentiality is required, the parties may enter into a separate non-disclosure or confidentiality agreement.
Nothing published openly on the public sections of the website should be assumed to constitute confidential information solely because it is protected by intellectual property rights.
11. Personal Data and Privacy
Personal data may be collected where necessary to respond to enquiries, manage professional relationships, process transactions, administer accounts, issue invoices or provide requested services.
Such information will be processed in accordance with applicable French and European data-protection legislation, including the General Data Protection Regulation (GDPR).
Personal data may, where necessary, be processed by authorised technical or professional service providers involved in operating the website or delivering the requested service, subject to applicable confidentiality and data-protection obligations.
Depending on the applicable legal basis and circumstances, individuals may exercise rights including access, rectification, erasure, restriction, objection and, where applicable, data portability.
Requests concerning personal data may be addressed to the website owner through the contact details provided on the website.
Reasonable technical and organisational measures are taken to protect personal information against unauthorised access, alteration, disclosure or loss.
12. Cookies
The website may use cookies or similar technologies necessary for its operation, security, preferences, analytics or other permitted purposes.
Where legally required, non-essential cookies will be used only after the appropriate consent has been obtained.
Users may manage their cookie preferences through the available consent interface and/or their browser settings.
Disabling certain cookies may affect the functionality of parts of the website.
13. Third-Party Websites and Services
The website may contain links to websites, platforms or services operated by third parties.
Such links are provided for information or convenience only. Irene Capistran does not control third-party websites and is not responsible for their content, availability, security, privacy practices or services.
The presence of a link does not imply endorsement, partnership or affiliation unless expressly stated.
14. Disclaimer and Limitation of Liability
The website and its publicly available material are provided for informational, artistic, creative and professional presentation purposes.
No guarantee is made that the website will operate continuously or without technical interruption.
To the extent permitted by law, Irene Capistran shall not be liable for loss arising solely from:
temporary unavailability of the website;
technical incidents outside reasonable control;
unauthorised acts of third parties;
reliance on third-party websites or information;
or use of the website contrary to these Terms.
Nothing in these Terms excludes or limits liability where such limitation would be prohibited by applicable law.
15. No Transfer Through Submission or Communication
Correspondence, discussions, meetings, pitches, submissions or exchanges relating to creative projects do not by themselves constitute an agreement to purchase, produce, represent, finance, publish, license or otherwise exploit a project.
Similarly, disclosure of a project to another person does not transfer ownership of the underlying protected material.
Any commercial exploitation, option, acquisition, representation or production arrangement requires a separate written agreement.
16. Governing Law and Jurisdiction
These Terms & Conditions are governed by French law.
Subject to any mandatory jurisdictional rules applicable under French or European law, disputes relating to this website, its professional services or these Terms shall be submitted to the competent courts in Paris, France.
